More information on Environmental Compliance Approval

As environmental regulations become increasingly complex, ORTECH provides cost effective regulatory compliance solutions to industrial, manufacturing, municipal and renewable energy sectors. An Environmental Compliance Approval (ECA), formerly known as a Certificate of Approval is a permit issued by the Ministry of Environment, Conservation and Parks (“MECP”), formerly Ministry of Environment and Climate Change (“MOECC”) for air emissions from a facility. In Ontario, nearly all industrial facilities, and many other facilities, require an ECA.  The ECA must address all contaminants (including noise) emitted into the environment and should be amended before a facility makes any process, operational, or equipment changes that affect emissions.

Facilities may also apply for ECAs with Limited Operational Flexibility (ECAwLOF), formerly known as Basic Comprehensive Certificates of Approval, which allow the facility to make some modifications without first obtaining an ECA amendment. This allows facilities to adapt quickly to market changes. The limited operational flexibility condition is generally granted for 10 years.

ORTECH can assist you in preparing and submitting an ECA application (with or without Limited Operational Flexibility). As part of the application process we will provide the following services:

  • Discuss the pros and cons of an ECA with Limited Operational Flexibility;
  • Provide a list of information required to complete the application;
  • Complete a site visit;
  • Review your current Emission Summary and Dispersion Modelling (ESDM) Report, if available, and update to include any changes;
  • Complete dispersion modelling and compare results to MECP Point-of-Impingement Limits;
  • Complete primary or secondary noise screening and coordinate an Acoustic Assessment Report (AAR), if required;
  • Assemble the ECA application, including the ESDM Report, required MECP forms and supporting information;
  • Regularly follow up with the MECP to check the status of the application;
  • Assist in answering any questions the MECP review engineer may have; and
  • Review the draft ECA.

ORTECH can assist in maintaining compliance with the new permit by providing the following services, if applicable:

  • Assist in preparing an operating manual;
  • Complete source testing and/or odour testing;
  • Prepare and maintain a modification log;
  • Coordinate Maximum Concentration Level Assessments;
  • Update the ESDM Report, as required, to maintain an ESDM Report which reflects the current operations; and
  • Prepare the Annual Written Summary Forms and supporting documentation.

How to Permit your facility using Environmental Activity and Sector Registry

The Ministry of Environment, Conservation and Parks (“MECP”), formerly Ministry of Environment and Climate Change (“MOECC”) has finalized a new regulation, requiring certain facilities to register their activities related to air and noise emissions on the province’s Environmental Activity and Sector Registry ("EASR"). The new regulation applies to all facilities which are not specifically excluded in the regulation either due to their primary activity code (NAICS code) or specified activities (i.e. processing of metal outdoors).  The requirements for the Air EASR process differ from the Environmental Compliance Approval (“ECA”) process in that review and approval from the MECP is not required.

Under the new process Facilities are required to submit an application, maintain documents and  records.  Approval and authorization is essentially granted upon registration, allowing Facilities to implement changes to  operations or start construction on new equipment installations.  This self-permitting approach is meant to improve the time it takes for industry to obtain air and noise permits.

When do I need to do this?

After December 31, 2016, if you make changes to your current emission related operations or if you install new equipment that have emissions, you must determine if your Facility is required to register for an EASR  to replace your current ECA. Note: The EASR applies to sectors deemed by the MECP to present low-risk for air and noise emissions.  For all other sectors, the former ECA Application process applies to  industries such as cement manufacturing, mining and chemical manufacturing, etc.

What are the requirements for the EASR process?

  1. Assess all emissions from the facility.
  2. Assess all substances that have no MECP limits.
  3. Assess noise and odour emissions.
  4. Develop and implement noise and odour mitigation control plans (i.e. odour control reports), if required.
  5. Develop maintenance and operational procedures, complaints and record management requirements.

The trade-off is the significantly reduced approval time through the self-registration process of the EASR. NOTE: Most Air Quality Consultants have to outsource the Odour consulting. ORTECH knows Emissions Summary and Dispersion Modelling (ESDM) Reports

Both Environmental Compliance Approval (ECA) and Air Assessed Environmental Activity Sector Registry (" EASR") require an Emissions Summary and Dispersion Modelling report.  An Emissions Summary and Dispersion Modelling ("ESDM") Report is a report that, as its name implies, covers an assessment of air pollution emissions from a facility, and how they disperse after they are released. An ESDM report must specifically include the content listed in, and use the methodologies described in, section 26 of O. Reg. 419/05. Emission Control Solutions for Combustion Generators!

What are Emission Control Solutions ("ECS")?

As electricity costs continue to increase, more and more high electricity use consumers are evaluating ways to generate their own power.  Often, one of the most cost-effective ways of generating electricity is to utilize existing assets such as emergency generators.  The challenge is that often these combustion generators do not meet current regulatory standards and the facility is faced with the decision to either purchase new equipment or retrofit their existing assets.  Emission Control Solutions (“ECS”) can be a cost-effective alternative to buying new generation equipment.  Diesel and natural gas combustion generators can be retrofitted with controls to reduce emissions of various pollutants to levels in line with current regulatory requirements.

How can an ECS help your business reduce emission?

Installing an ECS s may allow your combustion generator to be used for tasks other than emergency or standby generation.  Other uses could include electricity peak shaving or demand charge reduction initiatives.  However, these other uses can trigger lower regulatory emission limits for parameters such as Carbon Monoxide (“CO”), Particulate Matter (“PM”), Nitrogen Oxides (“NOx”), Total Hydrocarbons excluding methane (“NMHC”) or Sulphur Dioxide (“SO2”).   Retrofitting an asset by installing an ESC will allow these combustion generators to be permitted and repurposed for these other uses.

Emissions Inventory and Reporting is our specialty.
